How does the Aviation Safety Council (ASC) independently conduct the investigation?

The purpose of aviation occurrence investigation carried out by the ASC is to prevent the similar occurrences from reoccurrence, different from the civil aviation authority designed to carry out supervising jobs, such as enacting regulations, punishing the violators, supervising the airlines operations, etc. Looking around the accident investigation organizations internationally, such as the United States, Canada, France, Germany, Britain, Norway, the Netherlands, Switzerland, Denmark, Finland, Sweden, Australia, New Zealand, Japan South Korea, Indonesia, Russia and the Republic of China, all of these countries own independent investigation agencies. The International Transportation Safety Association (ITSA), a professional organization composed of transportation accident investigation agencies of many nations, particularly emphasizes the importance of independence of the investigating agencies. Independence is also a necessary condition for the agencies to join the association (ASC is a member of ITSA). The association asserts that the real causes of occurrences can only be found through independent investigation free of interference.

After the release of the investigation report, the ASC issues safety recommendations based on the probable causes of the occurrence to the civil aviation authority or relevant agencies. The safety recommendations for the improvement of aviation safety shall be supervised as watch items by the Executive Yuan and tracked by the ASC until the improvement measures are completed according to implementation plans.

If the occurrence investigation agency is under the Ministry of Transportation and Communications or the regulatory system, the agency may not be able to independently exercise investigations due to the administration sabjection relations, thereby affect to find out the causes of the occurrence. This is definitely not the best way to improve the aviation safety.
